TERMS

The rules for using this website and for coming to the sauna. Booking, membership, packs, gift cards and private events are all here. The privacy policy is separate and covers what we do with your details.

THE SHORT VERSION

You must be 18 to book, buy or hold an account. Under-18s come with an adult, and everyone signs a waiver.
Cancel a session free up to 24 hours before. Inside that, it is not refunded.
Membership has a two-month minimum and 30 days’ notice. You can pause it once a year.
Packs last a year. Gift cards never expire.
The sauna is hot and the Sound is cold. You come at your own risk, and the waiver says so in full.
Connecticut law applies. Disagreements go to arbitration, and you can opt out of that within 30 days.

WHO WE ARE

TYDE LLC, trading as TYDE HAUS (“we”, “us”), runs the community sauna at Bayley Beach, 11 Pine Point Road, Norwalk, Connecticut 06853, and the website at tydehaus.com (the “Site”). Questions about these terms go to haus@tydehaus.com.

By using the Site, or by ticking a box that says you agree when one is shown to you, you agree to these terms. If you do not agree, please do not use the Site.

1. USING THE SITE

Age

You must be 18 or over to make a booking, buy anything, or hold an account. Under-18s can come to the sauna with a parent or guardian, under the rules in section 5.

Accounts

You do not need an account to book one seat or to buy a gift card. Booking for other people, membership and packs use one. Keep your sign-in details to yourself, and tell us at once if you think somebody else has used your account. You are responsible for what happens under it until you do.

What you may do

We give you a personal, non-transferable licence to use the Site to look at sessions and to book and buy from us. You may not copy the Site, build another service from it, scrape it, or use it for anything commercial. Everything on the Site, including the TYDE HAUS name and mark, the photographs and the words, belongs to us or to the people who let us use it.

Changes

We may change or take down parts of the Site at any time. If we change these terms in a way that matters, we will say so on the Site or by email, and using the Site after that means you accept the change.

Other services

Payment is handled by Stripe under Stripe’s own terms. Links to other sites are not endorsements, and we are not responsible for them.

Feedback

If you send us ideas about the Site, we can use them without owing you anything.

2. SESSIONS AND BOOKING

Prices

A seat in a regular session is $44. Specialty sessions are priced as shown when you book. In a family session a child’s seat is $10. Prices include everything except what the Site says is extra. We may change prices for future sessions at any time; a booking you have already paid for is not affected.

How booking works

Choosing a time holds your seats for a short while so you can finish checkout. The booking exists when payment succeeds and you see a confirmation. If the session fills before your payment completes, we refund you in full.

Booking for others

If you book for other people you are responsible for giving us their correct names and contact details, and for making sure they know these terms and sign their own waiver.

Arriving

Sessions start on time. Please arrive fifteen minutes before. If you arrive late we will do our best to seat you, but the session is not extended and a missed session is not refunded.

Our right to refuse

We can refuse entry to, or ask anyone to leave, the sauna or the water, without refund, if in our judgement they are unwell, intoxicated, unsafe, or making the session worse for others. Alcohol before or during a session is not allowed.

Weather and closures

We run in most weather. If we have to cancel a session, for weather, a fault, or any other reason, we tell you as soon as we can and refund your seats in full, or move you to another session if you prefer.

3. CANCELLING A BOOKING

Free cancellation

You can cancel any seat up to 24 hours before the session starts, from your account or by emailing us, and the payment goes back to the card you paid with. Pack credits go back to your pack.

Inside 24 hours

A booking cancelled inside 24 hours, or not attended, is not refunded and credits are not returned. The seat was held for you and could not be sold to somebody else.

Rescheduling

To move a booking, cancel it inside the free window and book again. There is no separate rescheduling.

4. WAIVER, HEALTH AND CONDUCT

The waiver

Everyone who attends signs our liability and health waiver, once, before their first session. It is a separate agreement from these terms and it controls if the two differ. Adults sign for themselves; a parent or guardian signs for anyone under 18.

Your health

Sauna is extreme heat and the Sound is cold water. Both put real demands on the body. You are responsible for deciding whether it is right for you, for asking a doctor if you are not sure, and for stopping when you have had enough. Our hosts are not medical staff.

House rules

Swimwear is required at all times. Sit on a towel. Follow the host’s instructions. No glass, no alcohol, no photography of other guests without their agreement. Swimming in the Sound is at your own risk and unsupervised.

5. CHILDREN

The sauna is for ages 8 and up. Anyone under 18 must be with a parent or guardian in the same session, and the parent or guardian signs their waiver. Children’s seats at the child price are sold only in family sessions.

6. MEMBERSHIP

Plans

Community membership is $230 a month for one adult. Couples membership is $330 a month for two adults in the same household. Family membership is $480 a month for up to four people aged 8 and up in the same household. All cover unlimited regular sessions at your home house. Specialty sessions are 10% off, not included.

Billing

We take your card when you join and charge it monthly from the first charge date shown at checkout. Card details are held by Stripe. If a payment fails, we try again and tell you; membership benefits stop until it is paid.

Minimum term and notice

Membership runs for a minimum of two months from the first charge date, then continues monthly until you cancel. Cancellation takes effect 30 days after you tell us, or at the end of the minimum term, whichever is later. There are no refunds for part months.

Pause

You can pause your membership once in any twelve months for up to 31 days from your account. No payment is taken while paused and your benefits stop. Your rate is kept.

Fair use

Membership is unlimited use, not unlimited holding. A member may hold up to 4 upcoming bookings at a time. After 2 late cancellations or no-shows in a calendar month, that drops to one until the month resets. Repeated no-shows can lead us to end a membership.

Guest pass

Each membership includes one guest pass a calendar month: 25% off one adult seat for a guest in a regular session you are attending. It cannot be carried over.

Couples and family

The person who joins is billed and manages who is on the membership. The other people must live at the same address. An adult added to the membership creates their own account on the email address they were invited with. Children are listed by name and year of birth and are booked in by a parent. We may ask for proof of address.

Changes to benefits

We may change what membership includes, or its price, with at least 30 days’ notice by email. If you do not want the change you can cancel before it takes effect, and the minimum term is waived for that cancellation.

Not transferable

Membership is personal to the people named on it and cannot be lent, sold or shared.

7. SESSION PACKS

A pack of 5 sessions is $198 and a pack of 10 is $385. One credit is one adult seat in a regular session at Bayley Beach, for you or for a guest you book in. Credits do not pay for specialty sessions or children’s seats. Packs are valid for twelve months from purchase and unused credits then expire. Packs need an account, are not refundable once bought, and cannot be exchanged for cash. Credits used on a booking come back if that booking is cancelled inside the free window.

8. GIFT CARDS

Gift cards are sold as sessions, emailed as a code. The person you give it to can enter the code when they book online, no account needed, and each adult seat in a regular session uses one session, with the rest staying on the card; or enter it on their account to add all the sessions at once. Every visit is booked online before arriving; codes are not taken at the door. A booking cancelled in time puts its sessions back on the card. Gift sessions never expire and carry no fees. They cannot be exchanged for cash except where the law requires it, and we cannot replace a code that has been passed to somebody else and used. Treat the code like money.

9. PRIVATE EVENTS

A private booking of the whole house is priced by the hour as shown on the Site and is paid in full to hold the date. Free to cancel up to five days before. Between five days and 48 hours before, half the price is kept. Inside 48 hours, no refund. Everyone attending signs a waiver, and the house rules apply.

10. SHOP

Orders from the shop are paid online and collected at the sauna. We hold an uncollected order for 60 days and then refund it, less anything already used. Faulty items are replaced or refunded. Change-of-mind returns are accepted within 14 days for unused items in their original condition, collected back at the sauna.

11. NO WARRANTY AND LIMITS ON LIABILITY

THE SITE IS PROVIDED “AS IS”. TO THE FULLEST EXTENT THE LAW ALLOWS, WE MAKE NO WARRANTIES ABOUT THE SITE, EXPRESS OR IMPLIED, INCLUDING THAT IT WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM THESE TERMS OR YOUR USE OF THE SITE, AND OUR TOTAL LIABILITY UNDER THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID US IN THE SIX MONTHS BEFORE THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE.

Your attendance at the sauna, and the risks of heat and cold water, are covered by the waiver, not by this section.

12. YOUR RESPONSIBILITY TO US

If your breach of these terms, or your breaking of the law, causes a claim against us, you agree to cover our reasonable costs of dealing with it, including reasonable legal fees.

13. ENDING YOUR ACCESS

We can close your account or stop you using the Site if you break these terms. Bookings and memberships you have paid for are dealt with under sections 3 and 6. The sections that by their nature should survive, including 11, 12 and 14, continue after that.

14. DISPUTES AND THE LAW

Talk to us first

Most problems are sorted with an email to haus@tydehaus.com. If you have a dispute with us, write to us describing it, and we will try to resolve it with you within 45 days.

Connecticut law

These terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-law rules. Small claims can be brought in the small claims court where you live or in Fairfield County, Connecticut.

Arbitration

If we cannot resolve a dispute informally, you and we agree to resolve it by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, held in the county where you live or by video, rather than in court. This means no jury and no class action; claims are brought individually. Either side can still bring a small claim in small claims court, or ask a court to protect intellectual property. The arbitrator can award what a court could, to you individually. Each side pays its own legal fees unless the arbitrator finds a claim was frivolous.

Opting out

You can opt out of arbitration within 30 days of first agreeing to these terms by emailing haus@tydehaus.com with your name, address and a clear statement that you opt out. Opting out changes nothing else in these terms.

15. EVERYTHING ELSE

These terms, the privacy policy and the waiver are the whole agreement between you and us about the Site and the sauna. If any part is found unenforceable, the rest stands. If we do not enforce something once, we can still enforce it later. You cannot transfer these terms to anyone else; we can transfer them to a successor business. By using the Site you agree that we can send notices by email to the address on your account. We aim to meet the Web Content Accessibility Guidelines 2.1 at level AA; if anything is hard to use, email us and we will book you in by hand.
